Answer one of the following:

Option 1

Despite legal and policy developments on domestic violence, criminal justice responses including policing, continue to be inadequate. Critically evaluate.

Option 2

Critically evaluate how prisons in England and Wales can achieve the purposes of sentencing.

Example Answer - Option 1:

Despite legal and policy advancements aimed at addressing domestic violence, deficiencies persist in criminal justice responses, particularly in the realm of policing. While legislative measures have sought to provide protection and support for victims, the effective implementation and enforcement of these laws remain challenging. Law enforcement agencies often face difficulties in identifying and responding to domestic violence incidents due to the complex nature of these cases, including issues related to victim reluctance, lack of concrete evidence, and the presence of power dynamics within intimate relationships. Additionally, inadequate training and awareness among law enforcement personnel may hinder their ability to handle domestic violence cases sensitively and effectively. To address these shortcomings, there is a pressing need for ongoing training programs, increased community engagement, and a shift in the organizational culture of police departments to prioritize a comprehensive and victim-centered approach in handling domestic violence cases.

Example Answer - Option 2:

Achieving the purposes of sentencing within the prison system in England and Wales requires a nuanced and comprehensive approach. The primary aims of sentencing include punishment, deterrence, rehabilitation, and public protection. However, the current prison system faces challenges in balancing these objectives effectively. Overcrowding, limited resources, and a high rate of reoffending contribute to difficulties in providing meaningful rehabilitation programs. To enhance the effectiveness of prisons in achieving the purposes of sentencing, there needs to be a greater emphasis on rehabilitation and education within correctional facilities. Adequate funding for mental health and substance abuse treatment, vocational training, and educational programs can equip inmates with the skills necessary for successful reintegration into society, reducing the likelihood of reoffending. Furthermore, a shift towards restorative justice practices and community-based alternatives may help address the root causes of criminal behavior and foster a more holistic approach to achieving the multifaceted goals of sentencing in the criminal justice system.
