Executive management has asked you to prepare a memo that should describe whether a patient can make a successful claim for a breach of contract in this case.
In this 5–7-page memo, discuss whether the physician–patient relationship is a contract and what needs to be shown for a breach of contract to have occurred.
Approaches to consider:
· Is a physician to patient relationship a contract? (Contract meaning something that is a promise that is enforced by law)
· What needs to be shown for a breach of a said contract?
· Can the patient make a successful claim for a breach of that said contract?
· What is a contract and does the patient actually have a contract with a physician?
· What has to be in place for a contract to be effective?
· If a contract exists between the physician and patient, does it have to be a written contract?
